The following is a sample contract for leasing a property:
LEASE AGREEMENT
This Lease Agreement, effective as of ………… day of …………………………
is entered into between …………………………………………………………..… “(Lessee”)
and …………………………………………………………………………………(“Lessor”).
The Lessee requires suitable residential accommodation and the Lessor represents that he / she owns premises located at ………………………………………… ………………………………………………………………… (“Premises”) and is ready and willing to lease them, or is authorized by the owner thereof to lease them, under the following terms and conditions:
THE LEASE TERM
- The lease shall be for an initial period of ……………………………. from ……………………………… through ………………………………… and is being rented unfurnished/furnished as per attached inventory.
2. The Lessee shall have the option to renew the lease for a further period of …………………………… on the same terms and conditions stipulated herein, provided that the Lessor shall be given at least one (1) month notice of Lesse’s intention to renew this Agreement.
3. It is understood and agreed that the use of the premises also includes, as applicable, the use of reserved parking space(s) in and around the building/premises, garage and the enjoyment of the available facilities of the common area and the services of a concierge/security, as appropriate.
THE RENTAL COST
4. The rent shall be ………………………… per month payable in advance on the first day of each month.
MAINTENANCE OF THE PREMISES
5. The Lessor shall, at Lessor’s own cost and expense, maintain the premises in a good state of repair and maintenance, including repair of any defects that are not caused by the Lessee, and maintenance of all drainage, roofs, ceiling, plumbing, toilets, sewage, water, heating, air conditioning system, electrical wiring and all related equipment and installations. Repairs and maintenance shall be carried out promptly upon being notified by the lessee of the need thereof, but not later than three (3) days of receipt of a notice. In case of an emergency, repairs and or maintenance shall commence as soon as practicable following notification from the Lessee.
6. In the event the Lessor fails to maintain or repair the Premises as provided under herein within the prescribed time, the Lessee reserves the right to arrange for the maintenance or the repairs to be done, and shall deduct the costs of materials and labour from the monthly rent, provided, however, that the Lessee shall have given the Lessor prior notice of the anticipated cost.
TAXES, RATES AND ASSESMENTS
7. The Lessor shall be solely responsible for all taxes including municipal rates, assessments and all other governmental and local municipal charges in connection with the Premises.
UTILITY CHARGES
8. The Lessee shall pay all water, gas, electricity, telephone and cable bills, if applicable, as well as any other utility services provided to the premises and or consumed.
INSURANCE
9. The Lessor shall keep the premises insured against all risks, in particular, the risks of fire and flood, and shall provide the Lessee with a copy of said insurance policy.
FORCE MAJEURE
10. If the Premises are substantially damaged or rendered unusable due to circumstances, acts or conditions beyond the Lessee’s control or in case of force majeure, the Lessee shall have the option to terminate the lease and to recover any rent paid for the period beyond the date of termination of the Lease.
11. Force Majeure as used herein shall include Acts of God, actions of Governments and rulers of peoples, invasion, revolution, insurrection, war, (whether declared or not), hijacking, confiscation, vandalism, terrorism, civil disobedience, acts of a public enemy, disturbances, explosions or other acts of a similar nature or force, flood, fire, earthquake, storm, tempest or other natural disasters or phenomena and any other cause or failure or delay not arising through, or within control of either Lessor or Lessee.
DISPOSSESSION OF THE PREMISES
12. The Lessor undertakes not to dispossess the Lessee (either personally or through agents) of the premises or part thereof except for good cause or breach of a fundamental provision or obligation of this Agreement.
VACATION OF THE PREMISES
13. Upon expiration or termination of the present Agreement, the Lessee shall vacate and surrender to the Lessor the premises in the broom-clean condition and in a state of order not worse than when it was first received, ordinary tear and wear excepted.
TERMINATION OF LEASE
14. This Agreement may be terminated by any of the parties hereto by giving the other party one (1) month written notice thereof.
ALTERATION OF THE PREMISES
15. The Lessee shall not make any structural alterations to the Premises without obtaining prior written consent of the Lessor.
REASONABLE RIGHT OF ACCESS TO THE PREMISES
16. The designated representative(s) of the Lessor shall have the right to enter the premises at any reasonable time in order to inspect its condition or to effect repairs, provided that written notice of at least two days shall be given to the Lessee.
